Terms of Service


1. Contracting parties

The terms and conditions detailed below concern the contract made between on the one hand the person making the booking and representing the group (hereinafter: Client), on the other hand BP Entertainment Ltd., registered under VAT no.: HU23368279 and with its registered seat at 1061 Budapest, Andrássy út 32., Hungary (hereinafter: StagHeaven), together mentioned as Parties.

 

2. Law governing the contract

Based on the travel destination the contract between the Parties is governed by the Hungarian law. Both Parties accept the exclusive jurisdiction of the local court of Budapest, Pest Central District Court and solve any dispute in connection with the contract hereunder.

 

3. Confirming and completing a booking

3.1. A booking is made and confirmed when the Client has made the deposit payment. Once StagHeaven has received the payment a confirmation e-mail with confirmation document is sent to the Client. This document confirms the booking.

 

3.2. Upon booking StagHeaven assumes that the Client represents the relevant group and that he and his group understands and accepts StagHeaven's terms of service and privacy policy.

 

3.3. Deposit to confirm activities: see deposit calculation chart in your price offer.

 

3.4. Deposit to confirm accommodation: see deposit calculation chart in your price offer.

 

3.5. After deposit payment the remaining balance is due and shall be settled upon arrival in cash in agreed currency. The entire amount shall be paid to a StagHeaven representative upon arrival, before the start of the first activity or occupying the accommodation.

 

4. Modification

4.1. This section regards changes in time/ date of arrival, activities to accommodation.

 

4.2. The modification of the contract is unrestricted until the booking is confirmed by the deposit payment mentioned in 3.1.

 

4.3. If a booking has been confirmed any modification can be made no less than 30 days prior to arrival, but is subject to availability and shall be done in writing. StagHeaven will do its best to fulfill the Client's request of change.

 

4.4. Modifications requested within 30 days of arrival are at the absolute discretion of StagHeaven, who reserves the right to refuse any modification.

 

4.5. In case of a modification the prices stated in the confirmed price offer will be re-calculated and eventually discounts granted in the confirmed price offer might be lost or decreased. If the Client does not accept the new price offer it is up to the Client to decide about an eventually complete/ partial cancellation of the whole order. In this case the 5th Section will apply.

 

5. Cancellation

5.1. This section regards complete or partial cancellation of activities or accommodation.

 

5.2. Any cancellation must be done in writing.

 

5.3. Prior to deposit payment (booking confirmation) any cancellation is free of charge.

 

5.4. Refunds and dead-lines:

5.4.1. Activities:

  1. a.) If Client cancels any activity after deposit payment (booking confirmation) and not less than 7 days prior to arrival StagHeaven will refund the total costs except for deposit paid on activity amount.
  2. b.) If Client cancels any activity less than 7 days prior to arrival, but more than 48 hours prior to arrival StagHeaven charges 50% of total activity cost.
  3. c.) If Client cancels any activity within 48 hours prior to arrival or case of no-show StagHeaven charges 100% of total activity cost.

5.4.2. Accommodation:

  1. a.) If Client cancels accommodation after deposit payment (booking confirmation) but more than 30 days prior to arrival StagHeaven will refund the total costs except for booking charges and fees occurred.
  2. b.) If Client cancels accommodation within 30 days prior to arrival or in case of no.show StagHeaven charges 100% of the accommodation cost.

 

5.5. In case of partial cancellation 5.4.1. and 5.4.2. will apply.

 

6. Pricing and payment

6.1. The prices on StagHeaven’s website are indicative “from” prices and do not serve as an official offer. StagHeaven guarantees the prices stated in the relevant price offer within the period of validity (see: price offer valid until). It is the discretion of StagHeaven to state the price offer’s period of validity.

 

6.2. According to a dynamic pricing policy StagHeaven might offer a higher per person price for smaller groups than for larger groups for the same activity.

 

6.3. The prices are indicated in EUR and payment shall be made in the currency agreed in the price offer. Payments in local currency (HUF) can only be accepted on the basis of the daily exchange rate determined by StagHeaven.

 

6.4. Once the booking has been confirmed as mentioned in 3.1. StagHeaven guarantees the prices stated in the last price offer, except in case of major currency fluctuations between deposit payment and date of arrival. In this case StagHeaven reserves the right to request additional payment to cover the difference occurred.

 

6.5. StagHeaven can not be held responsible for any additional and unforeseen costs caused by adverse exchange rates or for any charges made by account holder’s bank in connection with the bank transfer.

 

6.6. According to 3.3. and 3.4., if Client failures payment of remaining balance StagHeaven reserves the right to suspend or refuse provision of services and/ or granting of access to accommodation until total payment if fulfilled.

 

7. Accommodation

7.1. The Client shall obey accommodation rules and policies. StagHeaven can not be held responsible for any damage or loss caused by violation of these.

 

7.2. If Client does not obey accommodation rules and policies, and/ or if the Client testifies an unacceptable conduct, which disturbs other guests, and/ or violates rules and policies of accommodation and/ or the Hungarian law, and/ or is dangerous to the Client itself, the accommodation has the right to immediately refuse to accommodate of the Client. In this case StagHeaven or the accommodation does not refund any accommoadtion cost.

 

7.3. Accommodation management has the right to ask the Client for credit card or damage deposit at check-in. At the end of the stay, if no damage is caused, the card it not debited and/ or the deposit is re-paid.

 

7.4. StagHeaven can not be held responsible for accommodation not complying to quality conditions earlier accepted by itself.

 

8. Obligations of StagHeaven

8.1. StagHeaven is obliged to provide the services the Client orders and confirms according to the payment conditions. StagHeaven shall provide the services according to the schedule and the description detailed in the price offer. StagHeaven can not be held responsible for any errors, mistakes caused by the suppliers or for not perform according to the description provided by itself previously.

 

8.2. In certain cases the suppliers are providing disclaimer forms and by signing these the Client and the participants of the group accept the rules and takes full responsibility when participating.

 

8.3. StagHeaven can not be held responsible for any loss, damage, personal injury, harm or death caused by any activity provided. This dispute shall be solved between the Client/ participant(s) and the supplier.

 

8.4. StagHeaven reserves the right to change supplier without any consultation, if this fact does not affect the services provided by in a negative manner. If the activity itself or the supplier is a threat to Client’s/ participant(s)’ health, safety or life. In this case StagHeaven shall offer alternatives of the same quality and price. If StagHeaven is not able to offer at least one alternative of the same quality and price StagHeaven is obliged to refund the Client for the relevant activity.

 

9. Obligations of Client

9.1. After deposit payment Client is obliged to pay the remaining balance upon arrival in cash in agreed currency to one of StagHeaven’s representatives. Further on, Client shall appear on dates and times stated in the schedule.

 

9.2. In case of 20 minutes or longer delay of Client or any participant(s) of the group StagHeaven reserves the right to cancel the activity without refunding the Client, to begin/ start the activity without the full number of participants, or if this is not possible to cancel the activity.

 

9.3. Safety rules and instructions presented by StagHeaven’s representative, guide or supplier shall without any exception be obeyed. Breach of or not complying to this obligation might cause interruption or cancellation of the activity.

 

9.4. Client is obliged to show respectful and cooperative conduct against StagHeaven’s representatives, guides, suppliers and any third parties involved. In case this obligation is being violated in any manner StagHeaven’s representatives, guides and suppliers has the right to leave the group, to interrupt or to cancel the activity. If the Client or any of the participants of the group offend any of StagHeaven’s representatives, guides, suppliers or third party involved the representatives, guides and/ or suppliers all has the right to interrupt or cancel the activity. In the cases mentioned above StagHeaven has the right to refuse provision of further activities without making any refund to the Client.

 

9.5. In case the Client or any participant(s) of the group causes damage or injury any of StagHeaven’s representatives, guide, suppliers or third parties involved the representatives, guide or suppliers has the right to interrupt or cancel the activity immediately without any refund to the Client. If any of the cases mentioned above occurs StagHeaven has the right to refuse provision of further activities without any refund to the Client. Client shall compensate the damage or injury caused, StagHeaven can not be held responsible for damage or injury caused by Client and participant(s) of the group.

 

9.6. Client makes sure the member of his group are familiar with the obligations, terms and conditions mentioned in this document.
